Section 1.15 Lists of Removed Participants If a Subscriber withdraws from the Service, the Service is not required to provide any Services, including the continued inclusion of the Participant`s participation information. Prior to any deletion of the entries of a participant withdrawn from the service, the withdrawn participant must be informed in writing of the proposed deletion so that the withdrawn participant can inform its customers. A fair contract or list of owners must reflect a clear indication that the sale of the property in question depends on the acquisition of title by the potential seller. This notice must be provided in the Notes, Internet Notes, Owner Name, and Ownership Feature sections of the list. (l) Participants shall not make the identity of registrants available to another organization for compensation, unless (i) the Participant`s residential real estate brokerage activity consists primarily of listing or selling the types of property that are to be subject to the MLS; (ii) registrants are looking for property in a price range or location for which the participant does not normally provide real estate brokerage services; and (iii) the number of registration identities provided or the corresponding revenues generated constitute an insignificant part of the Participant`s real estate brokerage activity. For the purposes of this rule, “sale” does not include referring potential buyers to other real estate agents and “listing” does not include the recommendation of potential sellers to other real estate agents. (c) Unless otherwise specified in the VOW Policy or these Rules, a Participant is not required to obtain separate permission from other MLS Participants whose entries appear on the Participant`s VOW. The final closing of sales will be reported to the Multiple Registration Department by the Listing Broker within seven (7) days. (d) Subject to subsection (b), a Participant`s VOW may allow third parties (i) to write comments or ratings on certain Offerings or to post a hyperlink to such comments or ratings in direct relation to certain Offerings, or (ii) to display an automated estimate of the Market Value of the Offer (or a hyperlink to such an estimate) in direct connection with the Offer. The law requires a licensee to provide the owner with a copy of a summary of New Jersey`s N.J.S.A. Anti-Discrimination Act.
10:5-1 et seq. – commonly known as the Attorney General`s Memorandum – at the time of listing real property. The purpose of the memorandum is to assist owners as well as licensees in complying with New Jersey Anti-Discrimination Act and federal laws that prohibit discrimination in the sale or rental of real estate. Section 2.9 Notification of Cancellation of Pending Sale The registration desk will notify the service within 24 hours if a pending sale is cancelled and the listing will be restored immediately. Section 5.1 Participants as Principals If a Participant or a Licensee or Chartered or Certified Appraiser associated with a Participant has an interest in a property whose registration is to be disseminated through the Service, that person must disclose that interest when the Advertisement is submitted to the Service and such information will be shared with all Participants in the Service. ii. The type of registration contract, i.e. the exclusive right of sale or the exclusive agency. (i) Participants must sign the most recent license agreement with MLS. The communication software distributed by the Multiple Listing Service does not allow the member or subscriber to modify an advertisement that exceeds the scope of the ad reports approved in 1994 (short report and customer report).
Section 4.2 “Sold” Signs Prior to closing, only the listing broker`s “Under Contract” mark may be affixed to a property whose registration is subject to the Service, unless the listing broker authorizes the cooperating broker (seller) to affix such a sign. Section 1.9 List of Properties of Multiple Units All properties that should or may be sold separately must be submitted individually. If part of a submitted property has been sold, the listing will be considered cancelled and the rest of the property must be resubmitted or notified to the service. (c) The Terms of Use also expressly authorize MLS and other MLS Participants or their duly authorized representatives to access vow to verify compliance with the MLS Rules and to monitor vow`s posting of participant lists. The agreement may also contain other provisions agreed between the participant and the registrant. Section 2.6 The reporting of sales to changes in service status must be reported by the listing broker to the multiple registration service within twenty-four (24) hours of their occurrence. If the negotiations have been conducted in accordance with Article 2 (a) or (b) of this Agreement, the Cooperating Broker shall notify the Listing Broker of the accepted offers within twenty-four (24) hours of registration and the Listing Broker shall notify the MLS within twenty-four (24) hours of receipt of the Cooperating Broker`s notice. The remuneration indicated in the offers published by the Service will be displayed in one of the following forms: Key fields are provided to participants with a good reputation in the Service. The participant must sign an agreement with the service and make the payment before receiving the key boxes. (t) The display of expired and withdrawn offers is prohibited. An exclusive agency list must be identified by selecting Exclusive Agency in the Contract Type field of the listing. (k) MLS offers can only be excluded from display in the VoW of participants on the basis of objective criteria, e.B type of property, list price, geographical location, cooperative remuneration offered by listing brokers.
Section 11 Ownership of MLS Compilations and Copyright By submitting Advertisement Content to the Service, entrant represents and warrants that entrant is fully entitled to license the content of the real estate listing in accordance with and in accordance with this section and these rules and regulations, and thereby grants the Service the licensing authority to include the content of the property listing in its multiple copyrighted listing. Compilation of services as well as in each statistical report on comparative values. The content of the offer includes, among others, photos, images, graphics, audio and video recordings, virtual tours, drawings, descriptions, remarks, stories, pricing information and other details or information related to the listed properties. The listing broker reserves the right to determine the amount of remuneration offered to other participants (as sub-agents, purchasing agents or in other agency or non-agency functions defined by law), which may be the same or different. If the cooperating broker is not present at the presentation of the offer, the cooperating broker may make a written request, and the listing broker must provide written confirmation within 48 hours that the offer has been submitted to the seller or written notice that the seller has waived the obligation to submit the offer. . . .
